Terms of Service

These terms govern the use of the website located at LyricVue.com and lyricsvue.com and the associated video generation services (collectively, 'LyricVue', 'the Service', or 'the App').
Lyricvue service is operated by Vibe App Labs LLC.

1. Acceptance of Terms and Eligibility

By accessing or using LyricVue, you agree to be bound by these Terms of Service. You must be at least 18 years old and capable of entering into a legal contract to use the application.

2. Subscription Tiers and Credit Mechanics

  • Free Tier: Users may create up to 5 videos total (max 30 seconds each). These videos contain a LyricVue watermark which you are prohibited from manipulating or removing.
  • Second Tier: Includes videos up to 5 minutes, no watermark, and expanded preset effects.
  • Third Tier: Includes all Tier 2 features plus the ability to change lyric text and add custom images.

We reserve the right to modify these tiers, features, and the mechanics for video generation at any time for technical or operational reasons.

3. User Content and Explicit Disclaimer of Monitoring

You are solely responsible for any audio, text, or images you upload ("User Content").

  • No Duty to Monitor: You explicitly understand and acknowledge that LyricVue does not regularly monitor, verify, or approve the accuracy, reliability, or legal status of User Content.
  • No Copyright Checks: We do not perform any checks for commercial copyright infringements. Use of the service is provided on an "as-is" basis, and we assume no liability for the content you choose to upload.

4. User Warranties and Representations

By uploading audio or other content, you guarantee and warrant that:

  • The User Content belongs to you or you are explicitly authorized to upload and use it.
  • Your use of the content does not violate intellectual property rights, copyrights, or the privacy rights of any third party.
  • No license or other fees are incurred by LyricVue through the use of your uploaded content.
  • You are not acting in violation of any applicable law, including the EU AI Act where applicable.

5. Indemnification and Legal Liability

You agree to indemnify and hold harmless LyricVue, its directors, and affiliates against any third-party claims, losses, or expenses (including legal fees) arising from your misuse of the services or your violation of third-party intellectual property rights. You acknowledge that you carry the full burden of any legal action or lawsuit resulting from the videos generated with your audio, and you will be liable to us for any loss we suffer as a result of your breach of these warranties.

6. Disclosing Identity and Content Removal

  • Right to Disclose: We reserve the right to disclose your identity to any third party claiming that content uploaded by you constitutes a violation of their intellectual property or privacy rights.
  • Right to Remove: We maintain the right to remove any User Content at any time to ensure compliance with these terms or in response to legal or government requests.

7. Copyright Infringement (DMCA) Policy

If a copyright holder believes their work has been infringed, they may submit a DMCA Takedown Notice to our designated agent at legal@lyricvue.com. The notice must include a physical or electronic signature, identification of the infringed work, and a statement of good faith belief that the use is unauthorized.

8. Limitation of Liability

To the extent permitted by law, LyricVue shall not be liable for any indirect, incidental, or consequential damages, including profit or data loss, arising from your use of the application. Our total liability for any claim shall not exceed the amount paid by you for the service in the past 12 months or $100 USD, whichever is greater.

9. Governing Law

These terms are governed by the laws of the State of Delaware, and any disputes will be resolved through the exclusive jurisdiction of its courts.
